AFR Rates September 2023

The Internal Revenue Service provides various prescribed rates for federal tax purposes each month. These rates are known as Applicable Federal Rates and are published as revenue rulings. These rates determine minimum interest yields reportable on carryback financing.

The term Applicable Federal Rates (AFR) refers to a set of interest rates established by the Internal Revenue Service and used for various financial and tax-related purposes. These include establishing minimum interest rates on loans, calculating imputed interest for certain transactions, estate planning, and valuation of charitable gifts. AFRs are updated monthly based on marketable debt market yields, including U.S. Treasury bills.
The main purpose of these rates is to discourage individuals from engaging in tax evasion through below-market loan terms between family members and friends. By establishing a minimum benchmark, AFR rates help prevent this type of activity by ensuring that any loan terms that are lower than the established rate will be considered a gift and subject to gift taxes.
These rates also serve as a useful guide for anyone that is interested in purchasing real estate with seller financing or making a private loan to a friend or relative. Using these rates as a reference point, you can ensure that any loan terms comply with IRS regulations and that any interest charged is being calculated accurately. Depending on the nature of your transaction, you may also wish to consider consulting a tax professional for additional guidance.

The Internal Revenue Service has released the AFR rates for September 2023. These rates represent the minimum interest rate that should be charged for family loans to avoid tax complications. They also set the interest rate for a Section 7520 transaction, a common estate tax planning technique for reducing gift taxes.
